Confidentiality agreement Tekom International

The undersigned:

Working for: Tekom International (hereinafter Tekom) with its registered office and principal place of business in Hoofddorp

In the position of/employed by means of the framework agreement

Hereby declares the following:

1. Confidentiality is imposed on me regarding all particulars concerning or relating to our company, assignments and the (personal data) of customers/third parties who collaborate with us or who we engage from/for Tekom. I shall undertake to maintain strict confidentiality towards anyone who is unauthorised with regard to everything that is revealed as a result of my work and of which I know or may suspect that this information is of a confidential nature. This includes personal data, as referred to in the applicable Privacy legislation, including national laws for the implementation of the Privacy guidelines and the General Data Protection Regulation, which I have taken note of and shall take note of during my employment/internship period/assignment, except when obliged to provide this in the case of an instruction issued by or pursuant to the law;

2. I am aware that breaching this duty of confidentiality, either during the execution of the assignment and/or employment, or after termination hereof, is subject to the sanctions imposed by law (unlawful act/breach of contract, etc.) A breach of my duty of confidentiality occurs by disclosing any particulars of/personal data of customers of/third parties affiliated with Tekom or the work concerning or related to that, which is performed for Tekom, in whatever form to third parties, directly or indirectly;

3. I am aware that an immediately payable penalty of €500 per day, without demand or notice of default, will be imposed on me for (any) breach of the duties of confidentiality for each day that the breach continues, with a maximum of €20,000, notwithstanding the obligation to pay Tekom full compensation in this matter, if this should be more than the specified penalty amount, examples including fines that are imposed by the Dutch Data Protection Authority in the context of any breach of our obligations ensuing from the Privacy legislation including national laws for the implementation of the Privacy guidelines and the General Data Protection Regulation by breaching this confidentiality agreement;

4. I am aware that breaching the confidentiality provisions also constitutes a reason for Tekom for summary dismissal and/or immediate termination of the framework agreement/assignment.
